State: Terms of Service

The short version

State is a text assistant that helps you get into and out of mental states using techniques you record yourself. It is not therapy, not medical care, and not a crisis service. You're texting an AI, not a person. You must be 18 or over. It's free during the beta and it may break. What you write stays yours, we don't take a license to publish it or build anything else out of it.

If you're in danger, this is the wrong tool. Call or text 988 in the US or Canada, or call 911.

1. Who can use State

You must be 18 or over. State is not for children or teenagers, and we don't knowingly provide it to anyone under 18. If we learn a user is under 18 we close the account and delete the data.

You need a phone number that can send and receive messages, and you must be the person that number belongs to.

2. What State is, and what it is not

State helps you change your state: focus, calm, confidence, energy, motivation, getting out of a spiral or a funk. It works by remembering what has actually worked for you and offering it back when you need it.

State is not:

  • Not therapy or psychotherapy. It does not diagnose, treat, or provide treatment for any mental health or behavioral health condition.
  • Not medical care or advice, and not a substitute for it.
  • Not a licensed professional. Nobody providing State is acting as your therapist, counselor, physician, or clinician, and State does not act on behalf of one. Nothing it says is professional advice of any kind.
  • Not a crisis or emergency service. It cannot get help to you, and nobody is monitoring your messages for danger.

We make no claims about outcomes. We do not promise State will improve your mood, your performance, your sleep, your focus, or anything else. It's a tool for keeping track of what works for you, and how well that goes is up to you and your circumstances.

Do not use State instead of getting care you need. If something you're dealing with is beyond everyday state management, please talk to a professional.

3. You are talking to an AI

Every reply you get from State is generated by artificial intelligence. There is no human reading your messages and writing back. State will tell you this whenever you ask, and it will remind you periodically.

AI makes mistakes. It can be confidently wrong, misremember things you told it, or suggest something that doesn't fit your situation. Use your own judgment. You are responsible for what you decide to do.

4. Emergencies

If you are thinking about harming yourself, or you are in danger, stop reading and get help now. Call or text 988 (Suicide & Crisis Lifeline, US and Canada), or call 911.

State automatically detects certain crisis language and replies with these resources before its AI ever sees your message. That detection is a fixed pattern match. It is not reliable, it will miss things, and it is not a safety net. Nobody is alerted, and no one is coming. Do not rely on it.

5. Your content stays yours

You keep all rights to what you write. We do not claim ownership of your messages, your recipes, or anything else you put into State.

You give us permission to use your content only to operate State for you, to generate your replies, remember your techniques, and build your map. That's the entire license. Specifically, we do not take the right to publish it, redistribute it, sell it, build other products from it, or use it to train AI models. If we ever want to use your content for anything beyond serving you, we will ask you separately and specifically, and you can say no.

You're responsible for what you send. Don't send us other people's private information, or anything you don't have the right to share.

6. Your data, and why these terms are not your consent

How we handle your data is covered by our Privacy Policy and our Consumer Health Data Privacy Policy, which are part of this agreement.

Accepting these terms is not consent to our collection of your health-related data. We ask for that separately, in your own words, before we set anything up, because bundling it into a terms-of-service acceptance wouldn't be real consent, and under Washington law it wouldn't count as consent either. You can withdraw it at any time.

7. Messaging

State works over iMessage and SMS. By using it you agree to receive messages from us at the number you texted from.

  • Message frequency varies, it depends on how much you use it and any reminders you set.
  • Message and data rates may apply, depending on your carrier and plan.
  • Reply STOP at any time to stop receiving messages. Reply HELP for help.
  • We can't control, and aren't responsible for, delivery delays or failures caused by Apple, your carrier, or our messaging provider.

Text messages are not private the way an encrypted messaging app is. Our Privacy Policy explains this plainly, and it's worth reading before you tell State anything sensitive.

8. Beta

State is in beta and free. That means:

  • It will change, sometimes abruptly.
  • It may be unavailable, lose functionality, or behave unexpectedly.
  • Features may be added or removed without notice.
  • We may end the beta, or the whole service, at any time.

If we shut State down, we'll tell you first and give you a chance to get your data out or delete it.

9. Fair use

Don't use State to break the law, harass anyone, impersonate anyone, or attack the service. Don't try to break into our systems, scrape them, overload them, or get around rate limits and security controls. Don't resell it or use it to build a competing product.

Don't use State for anything requiring professional judgment: medical, legal, financial, or otherwise.

We may suspend or close an account that does these things.

10. Ending it

You can stop any time. Reply STOP to end messages, or text DELETE to delete your account and everything in it. Details on how deletion works, and its honest limits, are in the Privacy Policy.

We can close your account if you break these terms, if we're required to, or if we shut the service down. Except where you've broken these terms badly enough that we can't wait, we'll give you notice and a chance to get your data out.

11. No warranty

State is provided as is, without warranties of any kind. We do not warrant that it will be available, accurate, reliable, error-free, or fit for any particular purpose. You use it at your own risk.

12. Limits on our liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of State.

Nothing here limits our liability for fraud, for our own gross negligence or willful misconduct, or for anything that cannot lawfully be limited. Some places don't allow certain limitations, in which case they don't apply to you.

Because State is free, and because it makes no promises about outcomes, our total liability to you for any claim is limited to the amount you have paid us, which is zero, except where law requires otherwise.

13. Changes to these terms

We may update these terms. We'll post the new version here with a new date. If a change matters, if it materially affects your rights or how we handle your data, we'll text you before it takes effect. Continuing to use State after that means you accept the change. If you don't, text DELETE and we'll remove your account.

14. Governing law

These terms are governed by the laws of [STATE, to be completed], without regard to conflict-of-law rules. Nothing here removes any right you have under the consumer protection laws of the place you live.

15. Everything else

If any part of these terms is unenforceable, the rest still applies. Our not enforcing something isn't a waiver of it. These terms, plus the two privacy policies, are the whole agreement between us about State.
